Terms of Service

The Viral Marketing (“TheViralMarketing”, “we”, “us”) is a software business in India. We operate https://theviralmarketing.co and the product app at https://app.theviralmarketing.co.

We provide AI-assisted social media software as a service, including content generation, scheduling, and related tools. Features and limits may change.

You must be at least 18 and able to form a contract. The service is for businesses and professional use, not for children. You must provide accurate information, keep your credentials secure, and are responsible for activity under your account. Notify us promptly of unauthorized access.

Paid plans and prices are shown at checkout and on our pricing page. Plans auto-renew until you cancel or pause. You authorize recurring charges in the currency shown at checkout. We collect tax where the law requires it, including GST on eligible India charges. Otherwise prices exclude tax; you are responsible for any other tax that applies in your country.

Card and UPI details are entered on our payment processor’s checkout (Razorpay). We never store full card numbers. Unused usage is not refundable as cash.

Where a trial is offered, cancel before it ends and you will not be charged. Canceling a paid plan takes effect at the end of the current paid period. Pause stops future charges; you keep access through the date already paid. A cancelled subscription cannot be resumed — start a new checkout to subscribe again. We may change prices at renewal with notice. Promotional credits may be withdrawn.

You retain ownership of content you upload. You grant us a license to host and process it solely to operate the product for you. Generated drafts are yours to use, subject to third-party and platform rules. You are responsible for reviewing output before publishing. We do not use your content to train our models (see the Privacy Policy). Do not upload material you are not authorized to process.

You may not use the service to spam, phish, impersonate, harass, generate illegal content, infringe intellectual property, attack our systems, or violate the policies of networks you connect. We may suspend or terminate accounts that break these rules.

Publishing depends on third-party networks. Outages, policy changes, or revoked access may delay or block posts. We are not responsible for those platforms’ actions against your accounts.

The service is provided “as is.” We do not warrant uninterrupted availability, error-free AI, or specific business results.

To the fullest extent permitted by law, our total liability for claims relating to the service is limited to the fees you paid us in the 12 months before the claim. We are not liable for indirect, incidental, special, or consequential damages, lost profits, or lost data, except where a statute says we cannot limit that liability.

You may cancel anytime. We may suspend or terminate for breach, abuse, chargebacks, unpaid invoices, or as required by law. After termination we delete or anonymize personal data as described in the Privacy Policy.

These terms are governed by the laws of India. Courts in India have exclusive jurisdiction, except that mandatory consumer protections and courts still apply if you are a consumer in a place that does not allow this choice.

We may update these terms. The “Last updated” date will change. Continued use after the effective date means you accept the updated terms.
